On Thurday, April 23, 2009, SaveWCAL attorney Michael McNabb filed SaveWCAL's appeal brief with the Minnesota Court of Appeals. Copies were hand-delivered to the attorneys for St. Olaf College at Gray Plant Mooty, Minnesota Public Radio at Faegre & Benson and the Minnesota Attorney General's office.

St. Olaf College and Minnesota Public Radio now have 30 days to file response briefs. The Minnesota Attorney General's office may also file a brief.
Three appeals court judges will be selected to hear the case and a date will be set for oral presentations — which will be very different from the type of presentations made in district court..

Holy moly. I was reading the brief and I realized that I had completely forgotten that the Swanson AG office stated in no uncertain terms that WCAL was absolutely its own (or part of) a charitable trust. (Not that the AG's office was going to enforce the law and draw the ire of Bill Kling and MPR news!) I am so befuddled by the District Court judge's thinking…
